Privacy objections and digital evidence in criminal proceedings

The Court admitted chat logs and videos used to establish trafficking liability, within the circumstances of the investigation.

Case
People v. Eul Vincent O. Rodriguez
Reference
G.R. No. 263603
Published
December 3, 2024
Decision date
October 9, 2024

Facts and context

An anti-trafficking investigation used an undercover account to communicate with Rodriguez and record offers involving exploitation of minors. An entrapment operation followed. Rodriguez challenged the use of the digital material on privacy grounds.

Issue

Did the privacy objection require exclusion of the chat logs and videos used to establish criminal liability?

Ruling

The Court affirmed the conviction and rejected that objection. It applied the Data Privacy Act’s allowance for processing connected with determining criminal liability and protecting rights in court proceedings.

The materials helped establish the method of solicitation and exploitation. The decision addressed their use as evidence in this prosecution.

Practice implications

Parao Law practice guidance

For organizations and professionals

  • When relevant messages may become evidence, preserve the original conversation and its context. Keep dates, participant identifiers, and information about how the records were obtained.
  • Limit access to those handling the incident or proceeding. Evidence preservation does not require circulation through an entire organization or publication online.
  • For healthcare teams, route requests involving patient communications or records through a documented legal and privacy review. Identify the specific proceeding and the relevant material.

For lawyers

  • Analyze lawful acquisition, the basis for processing, relevance, and authentication separately. A response to a privacy objection does not automatically prove every evidentiary requirement.
  • Preserve a clear account of the device, account access, extraction method, and custody of the material. Avoid presenting an edited excerpt without explaining the surrounding exchange.
  • Request targeted disclosure and appropriate safeguards where sensitive information about uninvolved people appears in the same record.

Limits of the ruling

The decision is not permission to hack accounts, conduct unrestricted surveillance, or publicly distribute private medical information. Its treatment of evidence in a criminal investigation should not be generalized to every workplace or private dispute.

For general information. The full decision and later developments should be considered when applying a ruling to a particular matter.
