An independent-contractor label does not settle employment status

The Court examined actual control and economic dependence when assessing Lazada riders’ working relationship.

Facts and context

Riders engaged under an Independent Contractor Agreement were removed from routes and stopped receiving schedules. They challenged their dismissal after the labor tribunals had accepted the contractual classification.

Issue

Did the written label determine the relationship despite the way the work was organized?

Ruling

The Court found an employment relationship and ordered reinstatement with backwages. It examined engagement, payment, dismissal power, and control, together with economic dependence.

Route sheets, reporting requirements, and the integration of delivery into the business supported the result. The contractual denial of employment did not override the actual relationship.

Practice implications

Parao Law practice guidance

For healthcare organizations and businesses

  • Compare each engagement contract with day-to-day practice: who schedules the work, directs its performance, supplies resources, approves absences, and can end the arrangement?
  • Keep an accurate account of the professional’s independence and other work arrangements. Do not assume that payment per service or use of the word consultant decides status.
  • Before changing a roster or ending access to work, obtain a review of the relationship and applicable termination requirements.

For lawyers

  • Collect operational evidence as well as signed terms: schedules, instructions, payment records, reporting systems, and actual disciplinary practices.
  • Explain which facts establish control over the means and methods of work and how economic dependence bears on the analysis.
  • In physician engagements, distinguish clinical standards, credentialing, and safety requirements from other forms of managerial control. Assess the whole arrangement rather than importing a delivery-worker outcome mechanically.

Limits of the ruling

The case concerned Lazada riders. It does not classify every visiting physician or independently engaged healthcare provider as an employee. The healthcare discussion is a practical application of the need to examine actual arrangements.
