Hospital probationary employment: standards and termination records
Passing evaluations and unsupported later criticism undermined the hospital’s dismissal of a probationary employee.
Facts and context
Barbosa entered a six-month probationary hospital appointment with successive nursing and supervisory training roles. The hospital terminated her despite passing evaluation scores. Its negative feedback was issued after termination without a corresponding performance evaluation.
Issue
Was dismissal justified, and were backwages limited to the remaining probationary period?
Ruling
The Court found the dismissal invalid. It emphasized reasonable regularization standards communicated at engagement and the employee’s actual evaluations.
Backwages for illegal dismissal are not capped at the end of probation. They extend to actual reinstatement, or to finality of the decision where reinstatement is infeasible. The Court applied the latter endpoint in Barbosa’s case.
Practice implications
Parao Law practice guidance
For healthcare organizations and businesses
- Give the employee clear role expectations and evaluation standards at engagement. Identify who evaluates each training stage and how results are documented.
- Record concerns when they arise, with supporting observations and a fair opportunity to address them through the applicable process. Avoid reconstructing reasons after a termination decision.
- Before taking action, compare the proposed ground with all evaluation scores, attendance records, communications, and the contract. Escalate inconsistencies for review.
For lawyers
- Separate failure to meet regularization standards from other possible grounds of dismissal. Test both the factual ground and the required procedure.
- Obtain dated evaluation forms and evidence that the standards were communicated. A general statement of dissatisfaction may conflict with the employer’s own records.
- Assess exposure beyond the nominal probation end date; do not calculate risk solely by counting the remaining months of the contract.
Limits of the ruling
Probation is not immunity from lawful termination, but it does not remove security of tenure. The case concerned employment, not PRC discipline or whether a professional license should be suspended.
