2026 MCLE Rules: what lawyers should check now
Effective September 15, 2026, the Supreme Court’s new MCLE Rules retain 36 credit units per three-year cycle while allowing a general or practice-focused program. Here is what lawyers should check during the transition.
Effectivity date
The 2026 MCLE Rules took effect on September 15, 2026, as confirmed by MCLEO Advisory No. 02, Series of 2026. The MCLE Office says implementation is in a transition period while the corresponding implementing regulations are being prepared.
What changed
The older framework divided 36 hours among several fixed subject categories. The 2026 Rules instead offer a general program across varied subjects or a focused program in a practice area, while preserving a minimum of six Legal Ethics units. They also give lawyers more explicit directions for ULAS credits, reporting, exemptions, and use of the compliance number.
Key provisions
Rule 2, section 2 keeps the 36-credit-unit requirement. A lawyer may take a general program across varied subjects or a focused program within a particular practice area. Either route requires at least six credit units in Legal Ethics. The three-year compliance cycle continues under Rule 2, section 3.
Rule 2, sections 2 and 9 recognize 15 MCLE credit units under the Unified Legal Aid Service (ULAS), subject to procedural guidelines. They must be applied as a full block to the current or immediately succeeding MCLE period, not split between periods; no more than 15 ULAS units may be applied to one period. Other excess MCLE units may carry over only to the immediately succeeding period.
Under Rule 2, section 9, a lawyer must submit a compliance report upon completing the required units or no later than 10 calendar days after the compliance period ends. A lawyer claiming exemption must submit an oath-bound attestation or application with supporting documents within the same post-period limit. Sections 10 and 11 address the compliance certificate and require its number and issue date on legal documents and in the written entry of appearance; a new number must be reported to the court or quasi-judicial body when the earlier certificate expires.
Rule 2, section 5 deems a newly admitted lawyer compliant from signing the Roll of Attorneys through the end of the current compliance period. Section 7 includes, among other grounds, lawyers aged 70 or older, subject to the rule’s stated conditions, and qualifying law faculty, bar reviewers, and supervising lawyers with 10 continuous academic years. The Board is to develop the specialization credentialing framework for Supreme Court approval (Rule 3); completing a focused program is not itself a specialist credential.

Demand letters and other signed work
- A demand letter prepared and signed as counsel is a legal document under the Rules’ definition, which expressly includes letters requiring a lawyer’s intervention. Put your MCLE compliance number and the certificate’s date of issue below your full name. The same Rule 2, section 11 instruction reaches lawyer-prepared pleadings, contracts, deeds, and bidding documents; it is broader than court filings. It does not mean every personal letter needs an MCLE number.
- Check that the certificate is valid before continuing legal work: Rule 2, section 10 says a lawyer may not practice without a valid compliance certificate. If you have pending court or quasi-judicial appearances and the old certificate’s validity has lapsed, file a manifestation stating the new compliance number and issue date. Update firm templates so an old number is not copied into the next letter or pleading.
A focused program is not a specialist title
- A lawyer concentrating on healthcare work may choose Board-approved courses on medical negligence, hospital regulation, health-data privacy, or related subjects as a focused program. The total is still 36 units per three-year period, including at least six Legal Ethics units (Rule 2, sections 2–3). Check the provider’s approval and the units actually awarded rather than assuming a course counts because its topic is relevant.
- Completing a focused program does not make the lawyer a certified healthcare-law specialist. Rule 3 leaves specialist credentials to a separate framework and credentialing process requiring Supreme Court approval.
Apply ULAS units as one block
- Rule 2, sections 2 and 9 permit 15 ULAS MCLE units, subject to MCLE Governing Board procedures. Under the ULAS Rules Manual, a covered lawyer who meets the required legal-aid hours, or a lawyer issued a Certificate of Exclusion, may qualify for the 15 units. Keep the ULAS compliance or exclusion record; mere participation in one legal-aid activity is not the same as completing the ULAS requirement.
- For example, applying 15 eligible ULAS units to a 36-unit MCLE period leaves 21 units to earn through other approved activities. Still plan for the six Legal Ethics units; do not assume ULAS credit fills that requirement without Board guidance. The 15 ULAS units must be applied in full to the current period or in full to the immediately succeeding period. You cannot place 10 in one period and five in the next, or apply more than 15 ULAS units to one period.
File and update details
- Submit the MCLE compliance report when the required units are complete or no later than 10 calendar days after the period ends (Rule 2, section 9). A lawyer claiming exemption must file the required sworn attestation or application and supporting documents within that same post-period deadline.
During the transition
- The rules took effect on September 15, 2026. MCLEO Advisory No. 02 says implementing regulations are still being prepared. Follow MCLE Office issuances for the procedures to claim focused-program or ULAS credit and to complete reporting under the new rules.
