Death certificates for insurance claims
Overview
For a veterans’ insurance claim, the NPC examined whether a full death certificate was necessary when a certificate confirming death might meet the purpose. It discussed possible lawful grounds, minimization, security, and accountability; the opinion does not make every insurer request automatically lawful.
Practice implications
Parao Law practice guidance
For physicians
When asked to release a death record, verify the requester and the stated purpose. Check whether proof of death is enough before disclosing the cause of death and other details. Route doubtful requests to the records or privacy officer.
For lawyers
Identify the precise entitlement and lawful basis for disclosure, then request only the fields needed for the claim. Document the release and safeguards. The NPC described a data-sharing agreement as an accountability measure, not a universal prerequisite.
